That blows. I got clocked at 123 in a 55 on my bike 10 years ago when there was literally NO traffic on the highway and get arrested. This guy goes 40 over and kills somebody and doesn't even get charged?

OK, I’m gonna be that guy:

Sure, this was awful, anyone who wasn’t a Cop would be facing atleast vehicular manslaughter charges for this. He was 40 MPH over the speed limit in an area with multiple cross-roads. Failure to yeild is a civil violation, in most places 40 over can land you “reckless endangerment” which is at minimum a misdemeanor and depending could be elevated to felony status with the right prosecution/wrong situation... getting off for being a cop :p

BUT (and here’s where I become that guy)

The article states that at the instance of impact, the Charger was traveling 68 MPH. The higher speed prior to impact most likely increased the distance traveled while attempting to avoid the collision. Perhaps due to the video and any type of accident reconstruction/forensic analysis it was deemed that even if the Charger was traveling at the speed limit, the collision may have been unavoidable due to the action of the other car prior to the event.

If he’s doing 55 then brakes, maybe the impact is at 30 instead of 68 though. Less energy transmitted; F=MA and whatnot....

Regardless, shit situation

Dude. He’s going 91, then brakes just before hitting the car, reducing his speed. Doesn’t change the fact that he’s going nearly twice the speed limit on a dark road. Plus he is just cresting the hill where the teens car was sitting. You can’t even see the turning car until it’s directly in front of the officer. No way they saw the cop coming, and even if they did, they wouldn’t have expected him traveling so fast. Add to this that speed is very difficult to judge at night.

Do you really need to see the moment of impact? This video shows the cop clearly breaking the law for several minutes before causing a multiple fatal accident. Officer should be convicted of 2 counts of voluntary manslaughter. Instead, not even a trial.

Yes, and I agree with your point. But I’m frustrated that the jury said he was going 68 at moment of impact, so therefore not really speeding that bad. They should have considered the dashcam evidence of 91mph as the offending speed, not 68.

I don’t think the situations are related. I’m assuming you’re talking about the guy who accidentally shot a guy in a darkened hallway. Totally different situations. However, I agree with your general point that the outcomes should have been different in both cases. Accidental shooting guy should have been exonerated, and this cop who was willingly breaking the law should be thrown in jail forever.

It looks like the crossing driver could not see the officer until the patrol car crested the hill. I imagine that from her point of view, the way was clear. Had the officer been driving at a legal speed, she probably would have cleared the intersection.

This is why speeding forfeits right-of-way in my area. Not sure about Georgia...

Yeah sorry, I didn’t mean they were related. I don’t know if he should’ve been exonerated because I didn’t really pay attention to that case (all I can tell is he had terrible training, couldn’t even do CPR), but what I meant was how come every other cop who killed somebody who didn’t need to be killed had no punishment at all? It’s ridiculous.

Yeah, if you can’t see the car until it’s that close, speed matters more than the traditional right-of-way here.

I don’t know if that hill had a lower advisory speed or a “hill obstructs view” sign, but at any rate the officer showed poor judgement. Even when emergency vehicles override right-of-way in the line of duty (not the case here), their drivers know that you still need to give other road-users time to react and yield.

As for Scott, he said he probably won’t go back into law enforcement, but that he wants to make the intersection where the crash occurred a safer place.

How so? That’s a 55mph highway. Stop signs? Traffic signal?
